Sheppard Airmen receive punishment for misconduct Published March 2, 2017 By Staff Report 82nd Training Wing Public Affairs SHEPPARD AFB, Texas -- Sheppard Airmen recently underwent non-judicial punishment proceedings for alleged misconduct with the following results: An airman first class assigned to the 364th Training Squadron received non-judicial punishment under Article 86 of the Uniform Code of Military Justice for being away without leave, or AWOL. The airman 1st class received a reduction in rank to airman, forfeiture in pay of $439, restriction to base for 30 days and a reprimand. A technical sergeant assigned to the 373rd Training Squadron, detachment 16, received non-judicial punishment under Article 112a of the Uniform Code of Military Justice for wrongful use of marijuana. The Airman received a suspended reduction in rank to staff sergeant, suspended forfeiture in pay of $1,573 for two months and a reprimand. An airman basic assigned to the 362nd Training Squadron accepted non-judicial punishment proceedings for alleged violations of Article 86 and Article 92 of the Uniform Code of Military Justice for being away without leave, or AWOL, and failure to attend training. The Airman’s commander determined that the member did not commit the offense and terminated the non-judicial punishment. An airman basic assigned to the 366th Training Squadron received non-judicial punishment under Article 92 of the Uniform Code of Military Justice for violating a lawful general order. The Airman received a forfeiture in pay of $250, restriction to base for 30 days and a reprimand. A senior airman assigned to the 80th Operations Support Squadron received non-judicial punishment under Article 112a of the Uniform Code of Military Justice wrongful use of a Schedule II controlled substance. The Airman’s commander determined that the member did not commit the offense and terminated the non-judicial punishment. A staff sergeant assigned to the 359th Training Squadron accepted non-judicial punishment proceedings for an alleged violation of Article 112a of the Uniform Code of Military Justice for wrongful use of D-amphetamine. An airman first class assigned to the 80th Operation Support Squadron received non-judicial punishment under Article 92 of the Uniform Code of Military Justice for driving on base with privileges revoked. The airman 1st class received a reduction in rank to airman and a reprimand. An airman assigned to the 366th Training Squadron received non-judicial punishment under Article 121 of the Uniform Code of Military Justice for theft of military property. The Airman received a forfeiture in pay of $100, restriction to base for 30 days and a reprimand. An airman assigned to the 361st Training Squadron received non-judicial punishment under Article 111 of the Uniform Code of Military Justice for driving under the influence. The Airman received a reduction in rank to airman basic and a reprimand. An airman first class assigned to the 364th Training Squadron received non-judicial punishment under Article 121 of the Uniform Code of Military Justice for theft of non-military property. The airman 1st class received a suspended reduction in rank to airman, forfeiture in pay of $878, extra duty for 15 days and a reprimand. An airman first class assigned to the 359th Training Squadron received non-judicial punishment under Article 86 and Article 92 of the Uniform Code of Military Justice for being away without leave, or AWOL, and failure to meet curfew. The airman 1st class received a suspended reduction in rank to airman, forfeiture in pay of $300 for two months, and a reprimand. An airman basic assigned to the 359th Training Squadron received non-judicial punishment under Article 134 of the Uniform Code of Military Justice for adultery. The Airman received a forfeiture in pay of $783 for two months and a reprimand. An airman first class assigned to the 362nd Training Squadron received non-judicial punishment under Article 111 of the Uniform Code of Military Justice for driving under the influence. An airman basic assigned to the 366th Training Squadron received non-judicial punishment under Article 92 of the Uniform Code of Military Justice for wrongfully entering a male dormitory. In addition to these non-judicial punishment actions, two airmen were tried in courts-martial: A technical sergeant assigned to the 82nd Force Support Squadron was tried under Article 80, Article 120b (not guilty) and Article 92 under the Uniform Code of Military Justice for attempt to commit a lewd act upon a child, attempt to commit a sexual act upon a child (not guilty) and dereliction of duty. The Airman received a reduction in rank to airman basic, forfeiture of all pay and allowances, confinement for one year and six months and a dishonorable discharge. An airman first class assigned to the 365th Training Squadron was found guilty under Article 92 and Article 111 of the Uniform Code of Military Justice for dereliction of duty and driving under the influence. The Airman received a reduction in rank to airman basic, forfeiture in pay of $1,066, four days’ confinement and restriction to base for 26 days. Editor's Note: Under the Uniform Code of Military Justice, Article 15 provides commanders the authority to impose non-judicial punishment. Non-judicial punishment provides commanders with an essential and prompt means to maintain good order, morale and discipline. It also promotes positive behavior changes in service members without the stigma of a court-martial conviction. It is considered when other non-punitive disciplinary measures - such as counseling, letters of reprimand, and administrative withholding of privileges - are not effective. By imposing non-judicial punishment fairly, swiftly and efficiently, the commander promotes good order and discipline within the unit. The rules and procedures for non-judicial punishment administration are governed by Air Force Instruction 51-202, "Nonjudicial Punishment."
